and Terms of Use for the HookIQ Apps and the website hookiq.app
§ 1 Scope and Provider
1.1 These Terms and Conditions apply to the use of the mobile applications HookIQ PREDATOR, HookIQ CARP and HookIQ TUNA (hereinafter individually or collectively referred to as "App") as well as the website hookiq.app (hereinafter "Website").
1.2 The provider is OnlineFishingCoach UG (haftungsbeschränkt), Raiffeisenstraße 19, 56753 Welling, Germany (hereinafter "Provider").
1.3 By installing or using the App or accessing the Website, the user accepts these Terms and Conditions. If the user does not agree to these Terms and Conditions, the user must not use the App.
1.4 The Provider reserves the right to amend these Terms and Conditions at any time with effect for the future. The user will be informed of material changes in an appropriate manner. Continued use after the amendment takes effect shall constitute acceptance.
§ 2 Description of Services
2.1 The App provides anglers with digital tools, in particular:
- Digital catch diary with photo, weight and length recording
- Interactive water map with custom markers
- AI-powered catch analysis (via Google Gemini)
- Wind map and weather forecast
- Ship tracking (AIS data)
- Tidal and water level information
2.2 Certain features are only available as part of a paid subscription (Premium). The exact scope of features for each edition is described in the App Store or Google Play Store listing.
2.3 The Provider reserves the right to expand, restrict or modify the features of the App at any time, provided this is reasonable for the user.
§ 3 Subscription and Payment Terms
3.1 Access to Premium features requires a paid subscription.
3.2 Payment is processed exclusively through the Apple App Store or the Google Play Store. The respective payment terms of the store operator apply.
3.3 The subscription renews automatically for the respective subscription period unless it is cancelled in good time before the end of the current term. Cancellation is made through the settings of the respective store.
3.4 Current prices are available in the respective App Store. All prices include the applicable statutory value-added tax.
§ 4 Right of Withdrawal for Consumers
4.1 Consumers generally have a 14-day right of withdrawal for distance contracts. As transactions are processed through the Apple App Store and Google Play Store platforms, their respective withdrawal and refund policies apply.

4.3 Please note that refunds for in-app purchases and subscriptions generally need to be processed through the respective App Store.
§ 5 Data Storage and Privacy
5.1 The App stores user data (catches, markers, settings) locally on the user's device by default. No registration or creation of a user account is required.
5.2 For the AI-powered catch analysis, data is pseudonymised and transmitted via a proxy server operated by the Provider to Google Gemini. Details can be found in the Privacy Policy.
5.3 The user is responsible for creating regular backups of locally stored data. The Provider accepts no liability for data loss on the user's device.
§ 6 Usage Rights and Intellectual Property
6.1 The Provider grants the user a simple, non-transferable, non-sublicensable right to use the App on the user's own devices within the scope of these Terms and Conditions.
6.2 All rights to the App, including source code, design, graphics, texts, logos and trademarks, remain with the Provider or the respective rights holders.
6.3 The user may not decompile, reverse engineer, modify or create derivative works of the App, unless permitted by mandatory law.
§ 7 Disclaimer and Limitation of Liability
7.1 The information provided in the App (weather data, tides, water levels, ship positions, AI analyses) is for informational purposes only. The Provider assumes no guarantee for the accuracy, completeness or timeliness of this data.
7.2 The App is not a navigation device and is not a substitute for official nautical aids. The user acts at their own risk at all times.
7.3 AI-powered analyses and forecasts are provided without warranty and do not constitute professional advice.
7.4 The Provider is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health. For slight negligence, the Provider is only liable in the event of a breach of material contractual obligations (cardinal obligations); in such cases, liability is limited to the foreseeable damage typical of the contract.
§ 8 Availability
8.1 The Provider endeavours to ensure uninterrupted availability of the App and the Website. There is no entitlement to continuous availability. Maintenance work, technical disruptions or force majeure may lead to temporary restrictions.
8.2 External data sources (e.g. weather, water levels, AIS) are subject to the availability of the respective third-party providers and may fail or change at any time without prior notice.
§ 9 User Obligations
9.1 The user undertakes to use the App only in compliance with applicable law and not to infringe the rights of third parties.
9.2 The user ensures that their device meets the technical requirements for using the App.
9.3 The following is prohibited:
- Automated reading of the App or its content (scraping, bots)
- Using the App for commercial purposes beyond its intended use
- Circumventing or manipulating the App's security mechanisms
§ 10 Termination
10.1 The subscription may be cancelled at any time through the settings of the Apple App Store or Google Play Store, effective at the end of the current billing period.
10.2 After cancellation, access to Premium features remains available until the end of the paid period.
10.3 The Provider is entitled to suspend a user's access with immediate effect in the event of serious violations of these Terms and Conditions.
§ 11 Applicable Law and Jurisdiction
11.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2 For consumers, the mandatory consumer protection provisions of the state in which the consumer has their habitual residence shall apply, insofar as they are more favourable.
11.3 The place of jurisdiction for disputes with entrepreneurs is Koblenz.
§ 12 Severability Clause
Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, that valid provision shall be deemed agreed which comes closest to the economic purpose of the invalid provision.
